Legal Provisions on Data Protection


§ 1 – Information on the gathering of personal data and provider identification

  1. In the following, we provide information on the gathering of personal data when using this website. Personal data are all data which refer to you personally, e.g. name, address, e-mail addresses, user behaviour.
     
  2. Responsible party in accordance with Art. 4 Sec. 7 EU General Data Protection Regulation (GDPR) is TRIACON GmbH, Volkmaroder Str. 8, D-38104 Braunschweig, info(at)triacon.de (see Impressum).
    Our Data Protection Officer is Mr Andreas Pinheiro LL.M., a.pinheiro(at)ap-datenschutz.de.
     
  3. Should we use services from subcontracted suppliers for certain functions of our offering – or would like to use your data for advertising purposes – you will find details below on the respective procedures. We also state the defined criteria for the storage period.
     

§ 2 – Rights, particularly those pertaining to information disclosure and revocation

  1. You have the following rights with regard to the personal data which we hold on you:

    –     Right to information disclosure,
    
–     Right to correction or deletion,

    –     Right to limitation of data processing,

    –     Right to revoke permission to process data,

    –     Right to data portability.
     
  2. If you have granted permission for the usage of data, you can revoke this at any time. Should the legality of the processing be based on your permission, this shall remain valid until the revocation is exercised.
     
  3. All requests for information, disclosure enquiries or revocations of the data processing permission should be sent by e-mail to info(at)triacon.de or to the address stated in § 1 Sec. 2.
     
  4. You can demand that we delete your data at any time. There may be legal minimum storage periods which allow us to store your data until the period ends.
     
  5. Should your data be incorrect, you have the right to demand correction of the data. We will fulfil this demand promptly.
     
  6. You have the right to receive the personal data you have provided to us in a readable format – where technically possible – in order to provide them to another company (right to data portability).
     
  7. You have the right to lodge a complaint with the regulatory authority responsible for you. You can find a list of data protection officers and their contact details via the following link:

§ 3 – Data security

  1. We undertake all current technical measures to ensure that your data is secure, particularly with regard to protection of your personal data against risks during data transfer and against data leakage to third parties. These measures will be continually adapted to the current state-of-the-art.

 

§ 4 – Gathering of personal data during informational usage and when making contact

  1. When using the website simply to gain information (i.e. when you are not registered and do not transmit any other information), we only collect the personal data which your browser sends to our servers. If you would like to view our website, we collect the following data, which are technically required to display our website and to ensure stability and security (legal basis is Art. 6 Sec. 1 S. 1 lit. f GDPR):

    –     Date and time of the enquiry
    
–     Time zone difference to Greenwich Mean Time (GMT)

    –     Content of the request (specific page)

    –     Access status/HTTP status code

    –     Data volume transmitted per visit

    –     Operating system and its user interface 

    –     Language and version of the browser software
     
  2. When you contact us by e-mail, we will record your e-mail address, your name and (if provided) your telephone number. The purpose of these records is solely to contact you in order to answer your questions.
     
  3. The legal basis for the stated data collection is the permission which you have expressed through visiting our website and confirming the cookie banner or by sending a contact form (Art. 6 Sec. 1 lit. a GDPR).
     
  4. We will only use your data for advertising purposes within the legally permitted scope. We only use your e-mail address for direct advertising of our own similar products and services. You can revoke the usage of your data for advertising purposes in writing or in text form at any time (e-mail to info(at)triacon.de). We refer in this case to our legitimate interest in advertising our products to our customers in accordance with Art. 6 Sec. 1 lit. f GDPR.
     
  5. In addition to the above-mentioned data, cookies are also stored on your computer. Cookies are small text files which are stored on the hard drive space allocated to your browser. These cookies allow the agent setting the cookie (in this case us) to gain certain information. Cookies cannot execute programs or transmit viruses to your computer. They serve to make the internet offering more user friendly and effective overall.
     

§ 5 – Cookies

  1. We use cookies on our website. Such cookies are necessary to allow you to move freely on the website and to use the website’s features; this also includes access to secure areas of the website. Cookies allow us to see who has visited the site and derive how often certain pages are visited, and which parts of the site are particularly popular. Session cookies store information about your activities on our website.
     
  2. The website uses the following types of cookies, whose scope and function are explained in the following:
    •    Transient Cookies (temporary usage)
    •    Persistent Cookies (usage until a certain expiration date)
    •    Third Party Cookies
     
  3. Transient cookies are automatically deleted when you close your browser. This includes session cookies in particular. These store a so-called Session-ID, with which different requests from your browser can be attributed to the same session. This means that the computer can be recognised when you return to the site. The session cookies are deleted when you log out or close the browser.
     
  4. Persistent cookies are automatically deleted after a certain time. This time can be different depending on the cookie. You can delete cookies in the privacy/security settings in your browser at any time.
     
  5. You can configure your browser settings as you wish and e.g. decline acceptance of third-party cookies or all cookies. We advise you at this point that this may result in not all of the functions of the website being available.
     
  6. We use cookies in order to be able to identify you when you return to our website should you have an account with us. Without cookies you will have to log in again every time you visit.

§ 6 – Data forwarding for website maintenance

  1. We will not forward your data to third parties unless we inform you of this.
     
  2. Our IT service providers have access to the data we store in order to correct errors and to enable us to perform the technical and organisational measures required. We refer here to our legitimate interest to secure our IT in accordance with Art. 6 Sec. 1 lit. f GDPR and the fulfilment of legal obligations in accordance with Art. 6 Sec. 1 lit. c GDPR.
     
  3. Our IT service providers are carefully selected and contracted in writing. They are bound to follow our instructions and we monitor them regularly. The service providers will not pass on this data to third parties.
     
  4. Data is not forwarded outside of the EU (EEA).  
     

§ 7 – Web tracking – Google Analytics

  1. This website uses Google Analytics, a web analysis service from Google Inc. (“Google”). Google Analytics uses so-called “cookies”, text files which are stored on your computer and enable an analysis of your usage of the website (s. § 5). The information of your usage of this website which is provided by the cookie are usually transmitted to a Google server in the USA and stored there. In the case of IP anonymisation being activated on this website, your IP address will be shortened within the EU Member States or in other states which are covered by the agreement on the European Economic Area. The full IP address is only transmitted to a Google server in the USA and shortened there in exceptional cases. Google will use this information on request of the operators of this website to evaluate your usage of the website, to compile reports on website activities and to perform other services relating to the website usage and internet usage for the website operator.
     
  2. The IP address transferred from your browser for Google Analytics will not be merged with other data from Google.
     
  3. You can prevent cookies from being saved on your computer via the settings in your browser software; we advise at this point, however, that this may cause some functions of this website to not work correctly. Furthermore you can prevent Google from collecting the data generated by the cookie and the data relating to your usage of the website (including your IP address) and from processing this data by downloading and installing the browser plug-in via the following link:  http://tools.google.com/dlpage/gaoptout?hl=de.
     
  4. This website uses Google Analytics with the extension “_anonymizeIp()”. This means that the IP addresses are shortened before further processing, which rules out any personal reference to the user. Should there be a personal reference in the data collected about you, this will therefore be excluded immediately and the personal data promptly deleted.
     
  5. We use Google Analytics to analyse website usage and to regularly improve our website. The statistics we receive help us to improve our offering and make it more interesting to you as a user. In exceptional cases where personal data is transmitted to the USA, Google is subject to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework. The legal basis for the usage of Google Analytics is Art. 6 Sec. 1 S. 1 lit. f GDPR.

  7. The website also uses Google Analytics for a cross-device analysis of visitor streams, which is carried out using a user ID. You can deactivate the cross-device analysis of your usage in your customer account under “My Data”, “Personal Data”.
     

§ 8 – PLUGIN: Google Maps Integration

  1. We use the Google Maps service on this website. This allows us to show you interactive maps within the website and enable the convenient use of the maps function.
     
  2. By visiting the website, Google receives the information that you have called up that specific page of our website. The data mentioned in § 4 of this declaration is also transmitted. This occurs regardless of whether you are logged into a Google account or not. If you are logged into a Google account, the data is associated directly with your account. If you do not wish the data to be associated with your Google account, you have to log out of your account before you activate the button. Google saves your data as a usage profile and uses them for purposes of advertising, market research and/or a personalised design of its website. Such an evaluation takes place especially (even for users who are not logged in) to display personalised advertising and to inform other users of the social network about your activities on our website. You are entitled to revoke permission to construct this user profile. To exercise this right, you must contact Google.

§ 9 – PLUGIN: Google Web Fonts

  1. This website uses so-called Web Fonts provided by Google to ensure that fonts are displayed uniformly. When you call up a website, your browser downloads the required Web Fonts to your browser’s cache in order to correctly display texts and fonts.
     
  2. This requires that the browser you are using connect to Google servers. This allows Google to know that our website was called up from your IP address. The usage of Google Web Fonts takes place in the interest of a uniform and appealing appearance of our online offering. This constitutes a legitimate interest as described in Art. 6 Sec. 1 lit. f DSGVO.
     
  3. If your browser does not support Web Fonts, a standard font from your computer will be used.
